The Sutter Butte Flood Control Agency (SBFCA) is the California Environmental Quality Act (CEQA) Lead Agency for the proposed Tudor Flood Risk Reduction Project (Proposed Project) (SCH#2023010087). SBFCA has directed the preparation of an Environmental Impact Report (EIR) for the Proposed Project in compliance with CEQA. SBFCA circulated a Notice of Preparation for the Proposed Project on January 6, 2023, and held two online public scoping meetings via Zoom on January 23, 2023. The Proposed Project would improve the remainder of the Feather River West Levee (FRWL) from the FRWL confluence with the Sutter Bypass East Levee to just east of SR 99.

Project Location

The Project Area is located in Sutter County, California, west of Garden Highway (SR 99), north of the Feather River, east of the Sutter Bypass, south of the community of Tudor, and northwest of the town of Nicolaus. The Project Area is defined as a corridor along the levee segment that is approximately 1.65 miles long and 200 feet wide, for a total of approximately 43.7 acres. The Project Area is now slightly larger than the 40.4-acre estimate described in the Notice of Preparation. All work planned for the Proposed Project would be conducted within the Project Area.

Project Description: Planned levee remedial measures for the Project include construction of a cutoff wall, a berm tie-in to the SR 99 embankment, pipe penetration improvements, and surficial geometry corrections. Improvement measures were developed based on the 100-year design water surface elevation (DWSE) provided in Design Water Surface Profiles for the Feather River West Levee Project, Addendum #2, dated December 2013 and prepared by Peterson Brustad, Inc.

Fill material for the levee and clay core would be obtained from either an off-site borrow source(s) or from excess material obtained from Project excavations. The construction contractor will be required to obtain off-site borrow materials, which may be imported to the Project Area from local sources or existing permitted commercial sources. Borrow sources for earthen materials are anticipated to be in the vicinity of Sutter and Yuba Counties. Other materials, such as aggregate base, bentonite for the cutoff wall, pipe, concrete products, and materials needed to support construction, would be obtained from off-site commercial vendors and sources.

The Project incorporates construction areas along the land and water sides of the levee. These areas would be utilized by the contractor for access, hauling, spoiling of material, storage, fueling, and other construction-related activities. Prior to and during construction of remedial measures, staging areas would be established to allow for efficient use and distribution of materials and equipment. Staging areas would be identified by the contractor during construction and would be located within the Project Area limits.

Construction is planned to be completed in one construction season, beginning in April 2025, and ending in December 2025. Typical construction activities could occur up to 14 hours per day (based on daylight hours and the construction phase), six days per week, Monday through Saturday, and between the hours of 6 a.m. and 8 p.m. Sundays may be utilized for equipment maintenance and additional work if necessary to meet the construction timeline. Crew sizes would vary depending on the construction phase and are estimated to be between 25 to 50 people. Work outside of the hours specified above for round-the-clock construction activities would be limited to cutoff wall installation but only if approved by SBFCA and if justified to complete the Project on schedule.
Potentially Significant Environmental Impacts: Potentially significant impacts to aesthetics, air quality, biological resources, cultural resources, geology and soils, hazards and hazardous materials, noise, transportation, and tribal cultural resources were identified in the Draft EIR. All potentially significant impacts would be reduced to a less than significant level with implementation of identified mitigation measures.

Hazardous Waste Sites: Pursuant to Section 15087(c)(6) of the Guidelines for CEQA, SBFCA acknowledges the non-existence of hazardous waste sites within the Project Area as reviewed by this Draft EIR.

Draft EIR Review and Availability: The public review and comment period for the Draft EIR will extend for 45 days beginning May 19, 2023, and ending July 3, 2023. The Draft EIR can be viewed and downloaded below (see table below). Appendices will be made available upon request.

The Sutter County Library Main Branch, located at 750 Forbes Ave, Yuba City, will also provide online access to the Draft EIR at the link above. The library is open Monday through Thursday, 9 am to 6 pm, and Friday and Saturday, 9 am to 5 pm.

Online Public Meeting: An online presentation and meeting will be held via Zoom for the public and regulatory agencies to have an opportunity to ask questions and submit comments on the Draft EIR. The meeting will occur during the public review period, on Wednesday, June 7, 2023, from 4 pm to 5 pm. The meeting will be accessible via the Meeting ID and Passcode or link below:
